ACCEPTABLE USE POLICY
By utilizing the services provided by Peko Payment Services LLC and any of its affiliated entities (“Peko”) through its website or app or any other digital interface (“Platform”), you hereby agree to adhere to the rules and standards outlined in this Acceptable Use Policy (“Policy”). These rules, as well as any guidelines published by Peko on its Platform from time to time, are binding on all users. Peko may modify this Policy at any time by posting a revised version on the Platform. By using the Service or accessing the Platform, you agree to the latest version of this Policy. You must refrain from using the Services and the Platform in any manner that contradicts these rules, standards, or applicable law in the relevant jurisdiction. For the purpose of this Policy, the term Services shall refer to the services made available by Peko and third party service providers through Peko’s Platform.
Prohibited Activities: While accessing the Platform and using the Services, you, or any third party accessing the Services and the Platform through you, will not:
- Use the Services or the Platform for any illegal, defamatory or fraudulent purpose or in violation of any laws including without limitation data, privacy, consumer protection, and export control laws;
- Violate or incite the violation of the rights of others;
- Probe, scan, or test the vulnerability of any system or network;
- Breach or circumvent any security or authentication measures;
- Access, tamper with, or use non-public areas or parts of the Services without authorization;
- Interfere with or disrupt any user, host, or network, such as by sending viruses, overloading, flooding, spamming, or mail-bombing any part of the Services or the Platform;
- Knowingly in any way use the Service or the Platform in any manner that would result in an infringement, dilution, misappropriation or other violation any intellectual property or proprietary rights of others, including but not limited to copyrights and rights arising from patents, trademarks and trade secrets (including the intellectual property rights or brand names of Peko or any of its partners or merchants);
- Access, search, or create accounts for the Services through unauthorized means, such as “scraping” or bulk account creation;
- Send unsolicited communications, promotions, advertisements, or spam;
- Send altered, deceptive, or false source-identifying information, including “spoofing” or “phishing”;
- Promote or advertise products or services without appropriate authorization;
- Abuse referrals or promotions to obtain more paid features than entitled;
- Circumvent the limitations of your paid subscription, if applicable;
- Sell, resell, or transfer or distribute the Services or the Platform in part or entirety to any third party under any circumstances;
- Utilize the Services in a situation where failure or fault of the Services could lead to death or a serious bodily injury of any person, or to physical or environmental damage;
- Connect to the network using any device other than an approved handset authorized by Peko or its partners;
- Publish or share materials that are unlawfully pornographic, indecent, or violent;
- Advocate bigotry or hatred against any person or group based on race, religion, ethnicity, sex, gender identity, sexual preference, disability, or impairment;
- Use the Services or the Platform to violate the privacy or confidentiality of others, including by transmitting, storing, displaying, distributing or otherwise making available others' private or confidential information (including without limitation their account names or personal data associated with their Service) without authorization; and
- Take any action that Peko deems inconsistent with acceptable business practices or other standards of behavior, as determined by Peko in its sole discretion.
Violation of this Policy will result in immediate suspension and/or termination of your access to the Services and the Platform. Peko reserves the right to terminate any other agreement between you and Peko then in effect, if applicable. Peko reserves the right to suspend or terminate your use of the Service or the Platform even if a breach is committed unintentionally or without your authorization if Peko believes that suspension or termination is necessary to ensure compliance with laws or to protect the rights, safety, privacy, security or property of Peko, its partners or customers or third parties.
Third-Party Services: Peko collaborates with third-party service providers to deliver certain Services through the Platform. You acknowledge and agree that Peko shall not be responsible or liable for any actions, errors, omissions, or breaches of these third-party service providers. The use of such Services shall be governed by the terms and conditions of the respective third-party providers.
Compliance with Third-Party Standards: You agree to comply with any additional policies, guidelines, or acceptable use restrictions imposed by third-party service providers whose services are utilized in conjunction with the Services provided by Peko.
Your Responsibility: You are responsible for violations of this Policy by anyone using the Services or the Platform with your permission or using your account on an unauthorized basis. Your use of the Services or the Platform to assist another person in an activity that would violate this Policy if performed by you is a violation of this Policy. This Policy applies to anyone accessing or using the Service or the Platform; however, each prohibition included in this Policy shall be interpreted to include, and apply to, any action directly or indirectly taken, authorized, facilitated, promoted, encouraged or permitted by a user of the Service or the Platform, even if such person did not
Data Sharing with Third Parties: In providing the Services, Peko may share limited personal or usage data with third-party service providers, as necessary to deliver specific features. Such data sharing shall adhere to applicable data protection and privacy laws.
Monitoring and Enforcement: Peko reserves the right, but does not assume the obligation, to investigate any violation of this Policy or misuse of the Services or the Platform. Peko has the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on the Service or the Platform that Peko finds to be in violation of this Policy. Peko may report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Such reporting may include disclosing appropriate customer data. Peko also may cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Policy.
Dispute Resolution and Governing Law: Any disputes arising out of or in connection with this Policy shall be governed by the laws of the jurisdiction specified in Peko’s Platform Agreement.
Anything not expressly covered under this Policy shall be governed by the applicable laws, rules, regulations, and industry standards in the relevant jurisdiction. In addition, such matters may also be subject to the terms and conditions, privacy policies, end-user license agreements (EULAs), service level agreements (SLAs), or any other agreements or policies applicable to the use of the Services or the Platform, as published or made available by Peko or its affiliated entities from time to time. In the event of any conflict or ambiguity, the provisions of such agreements and policies, along with the applicable law, shall prevail.
Reporting Violations: If you become aware of any violation of this Policy, you must immediately notify Peko by email at legal@peko.one and provide us with assistance, as requested, to stop or remedy the violation.
